Here’s exactly what can be found in an assets search and their methods to hide assets.

There are many reasons why you might want to do an asset search. But, there are two that are most popular:

  1. Pre-litigation determines whether the subject or company has sufficient assets to bring a suit against them. The legal process can be complicated and expensive for those who need them. It can save you thousands of dollars by not filing a lawsuit.
  2. A divorce: You want to locate assets you can seize when you need to get a judgment.

Three other reasons are equally important, but they don’t usually hold the same importance in the public’s mind. These are:

WHAT RESTRICTIONS ARE THERE ON ASSET SEARCHES?

Before 1999, searching for assets was like the wild west. There were about 220 companies that advertised about conducting these searches. Everyone performed them, and there were few restrictions, guidelines, or rules to what you could or could not do. Subterfuge was used to “gag” banks for information, and it was common for someone to run your credit reports and obtain valuable information under the “Inquiry” section.

WHAT IS THE GRAMM-LEACH-BLILEY ACT

Gramm-Leach-Bliley Act (GLB Act, or GLBA) was a game-changer. The GLBA. Federal law also knows the Financial Modernization Act of 1999 in the United States requires financial institutions to disclose how they share customer information and protect it. This law also establishes the standards for private investigators and other individuals interested in legally extracting financial data.

These rules are so strict that only five companies are authorized to conduct legitimate searches in the country. Non-compliance with the GLBA can result in severe penalties and imprisonment.

What data is available in an asset search?

The GLBA sent most Los Angeles private investigators and information brokers to the internet. Unfortunately, over 95% of these companies and individuals use the internet to find limited information. They will give you the data and pretend that they did financial research. You can access this information for free online, even though they charge only a few hundred dollars.

Only three types of asset searches are legal. These are:

  1. Basic Asset Search. This includes all personal data, twenty-year address history, confirmation S.S. #, birth date, and national property search. You should receive this report in court-ready documents. These documents may not be required in court. However, they are best avoided if the company that you are considering using does not meet this standard. The search should take no more than 24 hours. This product’s “average” legal price should be around $950.00
  2. Searches for Bank Accounts: Checking and Savings Account Searches.
  3. Stocks, Bonds, and Securities Searches.

The completion of numbers 2 and 3 should take 5 to 8 working days. Prices vary from one state to the next and include a nationwide search that is more costly.
